AA-33

The AA-33A form is the New York State Department of Motor Vehicles' (DMV) official document used to appeal administrative hearing determinations. It is applicable for matters such as chemical test refusals, fatal crash investigations, and disputes involving DMV-regulated businesses like repair shops or dealerships. Additionally, it serves as the mechanism to appeal the denial of a driver license or business permit application. This form cannot be used to appeal traffic ticket convictions from local courts or the DMV’s Traffic Violations Bureau (TVB).

To file an appeal, the appellant must submit the completed two-page form along with a non-refundable $10 fee per case within 60 days of the decision date. Appellants can choose to dispute the entire determination or only the appropriateness of the penalty. If the violation itself is disputed, a hearing transcript must be ordered and paid for separately, as the Appeals Board will only review the penalty if no transcript is provided. The form also includes an option to request a "stay" to stop a suspension or revocation while the appeal is pending, though these are granted at the board's discretion and require valid justification. Decisions are based solely on the existing hearing record; no new evidence or personal appearances are permitted.
