AA-33A

The AA-33A form is a legal document used to appeal a New York State DMV hearing determination, such as those involving chemical test refusals, fatal accidents, or business license sanctions for repair shops and inspection stations. To initiate an appeal, the appellant must submit the completed two-page form and a non-refundable $10 fee to the DMV Appeals Board within 60 days of the decision date.

The Appeals Board reviews the existing record, including exhibits and, if requested and paid for by the appellant, a hearing transcript. Without a transcript, the Board will only review the appropriateness of the penalty imposed rather than the facts of the case. Appellants must provide detailed written arguments on the form as personal appearances are not permitted; the Board may then affirm, reverse, or modify the original decision. Stay requests to stop a suspension or revocation pending the appeal are discretionary and require valid reasons provided on the form.
