MV-104C

The MV-104C, or Bicycle Crash Report, is a specialized New York State DMV form used to document accidents involving bicycles that occur on public highways but do not involve a moving motor vehicle. Under Section 605(b) of the Vehicle and Traffic Law, bicyclists must file this report within 10 days if the crash results in death or serious physical injury—defined as injury creating a substantial risk of death, protracted disfigurement, or impairment of health. If the bicyclist is a minor or physically incapacitated, a parent, guardian, or representative is legally responsible for submitting the form.

The form captures comprehensive data including the date, time, and precise location of the incident, as well as environmental factors such as light and road surface conditions. It requires specific details on the nature of the crash (e.g., collision with a pedestrian, fixed object, or animal), the extent of injuries, and the presence of traffic controls. Importantly, if a crash involves a moving motor vehicle, motorcycle, or moped, the standard MV-104 form must be used instead of the MV-104C. Completed reports are sent to the DMV Crash Records Center in Albany to create an official legal record of the event.
