MV-45

The New York State DMV Form MV-45, titled Statement of Identity and/or Residence by Parent/Guardian, is a legal affidavit used by applicants under the age of 21 who lack sufficient documentation to meet standard identity or residency requirements for a learner permit, driver license, or non-driver ID card. By completing this form, a parent or legal guardian provides four points of proof toward the applicant's identity and can also verify the applicant's New York State residency, which is specifically required for enhanced or REAL ID documents.

To utilize the form, the parent or guardian must accompany the applicant to a DMV office and present their own valid New York State photo document or alternative proofs that satisfy a six-point identity requirement. The applicant must still provide original documentation for their date of birth and Social Security number. A critical procedural requirement is that the form must be signed by both the applicant and the parent/guardian only in the presence of a DMV representative; signing the document beforehand may render it invalid. Misstatements on the form are considered a misdemeanor under Section 392 of the Vehicle and Traffic Law.
