SR-60

The Supporting Affirmation (Form SR-60) is a legal document used by individuals or companies to request that the New York State Department of Motor Vehicles (DMV) enforce Section 332 of the Vehicle and Traffic Law. This law authorizes the Commissioner to suspend the driver license and vehicle registration of any party who fails to pay a court-ordered judgment exceeding $1,000 resulting from a motor vehicle accident, collision, or crash involving property damage, bodily injury, or death.

To initiate the enforcement process, the judgment creditor must submit the completed and signed SR-60 affirmation along with several mandatory supporting documents: a transcript of the judgment with original certification from a court or attorney, a copy of the summons or docket card, and a copy of the formal accident report (MV-104 or MV-104A) or the original complaint. The form requires detailed information about the judgment debtor, the date of the occurrence, the current amount due, and verification that the time to appeal has expired or that no appeals are pending. Once submitted to the Insurance Services Bureau, the DMV reviews the documentation to verify its completeness and accuracy before taking administrative action against the debtor's driving privileges.
