VS-35

The Vehicle Safety Complaint Report (Form VS-35) is the official document used by the New York State Department of Motor Vehicles (DMV) to resolve disputes between consumers and automotive facilities, including repair shops, dealerships, and inspection stations. It allows vehicle owners to report issues such as unsatisfactory repairs, overcharges, unauthorized work, inspection fraud, or undisclosed vehicle defects.

For repair-related complaints, there is a strict filing limit of 90 days or 3,000 miles from the date of service, whichever occurs first, unless a written warranty provides an extension.

The resolution process typically begins with an attempt at informal mediation by a Consumer Services Representative, which can take six to eight weeks. If unresolved, the case may escalate to a formal investigation by an Automotive Facilities Inspector and potentially an administrative hearing. While an Administrative Law Judge can impose fines or suspend a facility's license, the DMV cannot force a shop to pay restitution; however, facilities may be offered the option to pay for direct repair costs or overcharges in lieu of more severe penalties. The form can be submitted by mail, email, or through a streamlined online portal, and must be accompanied by supporting documentation such as invoices and receipts.
