The Public Emissions Inspection Station Buy/Sell Agreement (Form VS-95) is a legal document required by the New York State Department of Motor Vehicles (DMV) when an official public emissions group 1a inspection station is being sold. This form must be submitted by the purchaser as part of their Original Facility Application to facilitate the transfer of the inspection license. To be eligible for this agreement, the selling and purchasing facilities must be located within the same county or within five miles of each other, and the selling facility must be in "good standing," meaning its license is valid, it owes no civil penalties, and it has no pending hearings, appeals, or litigation involving the DMV.
The form requires detailed information from both parties, including facility numbers, names, addresses, and contact information, as well as the NYVIP Unit Number for the Computerized Vehicle Inspection System (CVIS). It stipulates that upon approval of the purchaser's application, the selling facility's inspection license will be placed out of business; if the purchaser operates at the same location, all of the seller's business types will be closed. The document must be signed by all principals of the selling facility and notarized within 90 days of submission. Additionally, the parties are responsible for coordinating the transfer or purchase of CVIS equipment through the state's designated provider.
