MV-FOIL

The request process involves several key requirements and considerations:

- Applicability: Requesters should first determine if the record is available via form MV-15, as FOIL requests typically take longer to process.

- Submission: Completed forms can be submitted online through the GovQA portal or mailed directly to the FOIL Office at the NYS DMV in Albany.

- Privacy Restrictions: Access to "personal information" is strictly regulated by the federal Driver's Privacy Protection Act (DPPA). Requesters must often certify a permissible use, such as legal proceedings, insurance verification, or employer background checks for commercial drivers.

- Identity and Fees: Requesters must provide proof of identity, such as a driver's license or six points of identification. There are standard fees for searches and photocopies (often $11 per document), though certain public entities and volunteer organizations may be exempt from these costs.

- Record Limitations: Some information may be redacted or withheld according to legal exemptions, and certain records are purged after a specific retention period (typically 3 to 15 years depending on the violation type) unless a "Lifetime" record is requested.
